Rules, Terms and Conditions of "Yahoo! FIFA" Contest

The "Yahoo! FIFA" contest ("Contest") is organized by Yahoo Web Services India Private Limited, Mumbai ("Organizers"). Participation in Contest is purely voluntary. There is no participation fee, except for the applicable SMS /GPRS fee charged by respective opertors. To be eligible for the participation in the Contest, participant must be an Indian resident who has completed the age of 18 years at the time of participation in the Contest. Preliminary Contest shall be open from 00:00 hours on May 10, 2006 and close on June 5, 2006 at 23.59 hours ("Contest Period"). Entries received the closing of the Contest Period shall not be considered and the same will be invalid. Organizers shall not be responsible for delayed, lost, mutilated, corrupted or illegible entries. Organizers have the sole and absolute right to close or extend the Contest by any time frame at their discretion. To get a chance to win the prizes, users will have to participate in the Preliminary Contest via the SMS (on short code 58243) or Yahoo! India Website (on www.yahoo.co.in) or Yahoo! India WAP (on http://wap.yahoo.co.in) and complete the Contest successfully on the same platform; before the closing hours of the Contest Period. To be eligible for prizes, users would need to comply with the rules as set forth herein within the prescribed time period and complete the formalities as per Annexure 1 and Annexure 2 attached to these rules. Names of all persons who complete the preliminary contest successfully shall be fed into a computer and 35 names shall be drawn using the random number generation technique ("Short-listed Winners"). The Short-listed Winners shall need to send in a slogan. The organizers shall decide the final set of winners by selecting the best slogans ("Final Winners"). The best 8 slogans from the users shall be entitled to the first Prize, and the next 25 slogans shall be entitled to the runners-up prizes. The remaining slogan winners shall not be entitled to any prize. All slogans and data shall solely vest with the Organizers. A person shall not be entitled to more than one prize. The ranking of slogans shall be solely decided by the Organizers. The first prize is a trip to Germany to watch the first Quarter Final match live. This prize will include only an economy class return air ticket (ex-Delhi) to Berlin, three night hotel accommodation on twin-sharing basis at a 3 star hotel, one match ticket for the quarter final football match and a total allowance of Euro 350 per winner to cover all incidental expenses. No other costs or expenses will be paid by the Organizers and the winners will have to make their own arrangement for any other expenses not mentioned in the aforesaid prize. The runners-up prize shall be Adidas gift vouchers worth Rs. 2,500/- only. If more than one entry is received from the same user, either through the same medium or otherwise, only one such entry, of Organizers' choice, shall be eligible for participation. Names of Short-listed Winners shall be posted on Organiser's website http://www.yahoo.co.in ("Website") by June 7, 2006. Short-listed Winners shall also be informed individually by letters / emails / telephone calls sent through courier and/or on telephone or mobile phone. Short-listed Winners must send in their slogans on or before 23:00 hours on June 8, 2006. Slogans received after 23:00 hours on June 8, 2006 shall not be considered. Organizers shall not be responsible for delayed, lost, mutilated, corrupted or illegible slogans Organizers shall not be liable for delayed, lost or misdirected winning-letters or communications. Organizers shall not be responsible, if the Short-listed winners do not answer their mobile phone or if their mobile phone is switched off at the time they call. Names of Final Winners shall be posted on Organiser's website http://www.yahoo.co.in ("Website") by June 12, 2006. Final Winners shall also be informed individually by letters / emails / telephone calls sent through courier and/or on telephone or mobile phone. Organizers' decision in regard to Winners shall be final and binding. No communication or objection shall be entertained in this regard. Winners of any Prizes for traveling aboard shall have to make their own arrangement for traveling documents such as passport, visa, foreign exchange etc. at their own costs and expenses. Organisers shall not be responsible for making any arrangement for such documents and shall not entertain any request in this regard. In the event, any winner is unable to provide the Organizers with sufficient proof to the satisfaction of the Organizers of obtaining the travel documents by June 19 at 1800 hours, then the Organizers may forfeit the prize at their sole discretion and provide the prize to a new winner. Some of the requirements for German visa applications are provided in Annexure 1 for easy reference. Prizes received under Contest shall not be transferable and cannot be exchanged for cash or otherwise. Prizes cannot be substituted for other articles or gifts. Names, addresses, telephone numbers, e-mail identities and/or photographs of Winners may be used by Organizers at their sole discretion for sending out commercial information and/or for other commercial, publicity or promotional purposes. Winners who do not wish to receive such information may select such option on Website or clearly indicate so in a communication sent to Organizers by recorded delivery. Organizers shall not be responsible for any cost, expense or other liability whatsoever in relation to, arising from or connected with Prizes. Organizers shall not be responsible for any injury, loss, damage or other consequence whatsoever arising from, suffered or incurred by Winner from or in relation to Prizes. Contest shall be subject to the laws of India, including tax laws, rules and regulations as may be applicable to Winners. Winners shall be solely responsible for payment of applicable taxes to concerned authorities in respect of the Prizes as may be required by law prior to delivery of Prizes. Winners shall be required to show proof of tax payment and also sign a declaration as per the format provided by the Organisers on or before June 19, 2006, in respect of the taxes paid by the Winner as applicable on the prizes. In case of non-payment of taxes by any Winner by June 19, Prizes will be forfeited and may be given out to other participants as the Organisers may deem fit. A draft of the affidavit and indemnity bond is described as per Annexure 2 below. Organisers offer no guarantee or warranty in respect of any of the prizes. The manufacturers, services providers, supplier of the Prizes alone shall be liable for any guarantee or warranty, if any. All costs and expenses for collecting, redeeming or utilizing the Prize/s will be borne by the respective Winner and no claim of whatsoever nature will be entertained by the Organisers in this regard. Apart from the entitlement to the prize, the winner or his/her legal heirs will have no other rights or claims against Yahoo! India. All decisions of Organizers in relation to Contest shall be final and binding upon participants and Winners. No correspondence or objection shall be entertained in this regard. Any disputes arising from or in relation to Contest shall be subject exclusively to Mumbai jurisdiction. Contest is not applicable in the state of Tamil Nadu. Employees of M/s Yahoo Web Services India Private Limited and/or their associate, subsidiary or joint venture companies and their respective immediate family members shall not be eligible to participate in Contest. Any disputes arising from or in relation to Contest shall be subject exclusively to Mumbai jurisdiction. Participation in this Contest implies acceptance of all the terms and conditions of the Contest.

Annexure 1 German Consulate Visa Requirements: Completed Visa Application Form A passport valid for at least three months beyond the intended duration of stay in the Schengen States and at least with one empty page 3 Photos, in white background, very recent passport size photographs (3.5 x 4.5 cm, clear facial features on white background). The passport sized photo (minimum 3.5cm x 4.5cms) has to show the head against a white colored background. The photograph should not cut off hair and ears and the facial features must be very clear without any shadow. Photos of applicants wearing spectacles should be without reflection in order to enable identification of the eyes. Covering letter, Letter from the applicant, explaining the purpose and exact duration of stay on letterhead with complete personal address. Return Ticket (documentation to be provided by Yahoo! India) Exchange endorsed Or Credit Card Copy. Original Insurance. Proof of travel medical insurance for the entire duration of your visa. Prepaid Hotel Voucher from Germany. (Copy to be provided by Yahoo! India) IT return of the Company (last 3 years) original and copies Bank statement of the Company, original and copy- last 6 months Bank statement of the applicant, original and copy - last 6 months Record of ownership, fixed deposits, shares, etc. Proof of employment and leave letter on company's letterhead, stating designation and period of leave.
